Taiwan Reveals Draft AI Law for Stricter Regulation of Applications

Taiwan's National Science and Technology Council proposes a draft AI law to regulate AI applications, mitigate risks, and protect workers' rights.
"Taipei, July 16 - Taiwan's Cabinet-level National Science and Technology Council (NSTC) has unveiled a draft proposal for an artificial intelligence (AI) law, aiming to regulate the use and reliability of AI and mitigate associated risks. The proposed law would establish a framework for AI applications, including labeling, disclosure, and accountability mechanisms to enhance trustworthiness.
The draft law, which consists of 18 articles, would not apply to AI technology development and research stages prior to application release, supporting technological innovation. Additionally, it would require the establishment of regulations governing AI applications, AI accountability, and AI usage in the insurance industry.
The proposed law is Taiwan's first attempt to set up a legal framework for AI applications, focusing on risk mitigation. It stipulates the establishment of clear rules to reduce risk when using AI applications, such as the AI Risk Management Framework set by the US National Institute of Standards and Technology.
The framework would mandate AI security standards and verification mechanisms, along with accountability frameworks. Personal data protection authorities would assist regulators in avoiding unnecessary collection, processing, or use of personal data during AI R&D and application processes.
Furthermore, the proposal requires the government to regulate AI usage by developing tools or methods that prevent AI system misuse, which could be harmful to society or misleading to users. It also aims to prevent AI from causing damage to people's lives, bodies, freedom, property, social order, or the environment, as well as conflicts of interest, discrimination, bias, false advertising, and misleading or false information that would violate existing laws and regulations.
To protect workers' rights and interests, the government would provide employment guidance for those who become unemployed due to AI adoption. Estimates suggest that AI could cost around 30 percent of Taiwan's working population their jobs.
The draft law will be available for public comment for 60 days until September 13, after which the NSTC will review it and submit it to the Cabinet for approval by the end of October. If approved, the law will be submitted for deliberation and passage by the Legislative Yuan."
